General Terms and Conditions of Service

1. Applicability and Acceptance

These Terms and Conditions ("Terms") govern access to and use of all software, analytics tools, and related services (collectively, the "Service") offered by IntelliDeep. By accessing or using any IntelliDeep Service, you accept these Terms in their entirety.

2. Service Description and Ownership

IntelliDeep develops software tools that employ advanced algorithms for simulation, prediction, and optimization of decisions in environments of uncertainty and high risk. The purpose of the Service is to provide analytical assistance for strategic training.

Exclusive Ownership: All rights, titles, and interests in the software, underlying technology, analytical methods, proprietary algorithms, and the IntelliDeep brand are the exclusive property of IntelliDeep.

3. Data Use and Privacy

The continuous performance and accuracy of our Services depend on improving our models.

Mandatory Anonymization: All usage data, actions, and strategies recorded by the user through the Service ("Usage Data") will be automatically anonymized, aggregated, and depersonalized. IntelliDeep is committed to removing any personal or account identifiers before processing.

Purpose of Use: By using the Service, you grant IntelliDeep a license to use Anonymized Usage Data solely for the purpose of auditing, improving, and optimizing the performance and analytical accuracy of our Services.

Personal Data: IntelliDeep will not use users' personal identification data (name, email, etc.) for training its models.

4. Nature of Service and Limitation of Liability

4.1. No Warranty

Analytical Reference: IntelliDeep's Services are simulation tools. They do not constitute a guarantee of results nor a substitute for human judgment.

Review Responsibility: The effectiveness of the analysis provided by the Service is not guaranteed in real situations. The user is solely responsible for reviewing, validating, and applying the information and strategies generated.

4.2. Exoneration for Misuse

IntelliDeep assumes no responsibility for misuse, illegal use, or economic consequences arising from the use of the Service.

Risk and Losses: The user understands that they are operating in high-risk environments. IntelliDeep does not guarantee profits nor is it responsible for financial losses, damages, or harm suffered as a direct or indirect result of the use or interpretation of the Service.

Legal Compliance: The user is solely responsible for ensuring that the use of the Service complies with applicable legislation and the terms and conditions of any third-party platform or environment where they choose to apply the analysis.

5. Subscription and Payment (SaaS)

Access to the Services is through subscription plans. Details on fees, billing, renewal, and cancellation will be governed by the subscription policy applicable to the contracted product.

6. Community Provisions (if applicable)

If the Service includes features for sharing information, the user is fully responsible for any data they choose to make public. IntelliDeep is not responsible for the analysis or exploitation that third parties make of information voluntarily shared by the user.

7. Usage Restrictions and Prohibited Conduct

The user is strictly prohibited from using the Service for any purpose other than personal training and analysis. The following actions are expressly prohibited:

7.1. Reverse Engineering and Copying

Decompiling, disassembling, reverse engineering, or attempting to discover the source code, algorithmic architecture, training methods, or any trade secrets related to the Services.

7.2. Automation and Botting

Integrating, automating, or using the Service (or any information derived from it) with third-party software, scripts, or any system that allows real-time decision-making or automated use on gaming or risk platforms.

7.3. Data Mining (Data Scraping)

Extracting, copying, or collecting data, content, or the structure of the Service to use IntelliDeep's analysis in the development, training, or improvement of competitive AI models, algorithms, or services.

7.4. Resellers and Assignment

Selling, reselling, renting, assigning, or sublicensing access to the Service to third parties without IntelliDeep's express written consent.

8. User Accounts and Security

8.1. Credentials

The user is solely responsible for maintaining the confidentiality of their access credentials and for all activity that occurs under their account. IntelliDeep will not be responsible for losses or damages resulting from unauthorized use of your account.

8.2. Monitoring

IntelliDeep reserves the right to audit and monitor the use of the Service to ensure compliance with these Terms, including detection of usage patterns suggesting automation or reverse engineering.

9. Termination and Suspension of Service

9.1. Termination for Breach

IntelliDeep may suspend or terminate the user's access to the Service immediately and without prior notice if it determines, at its sole discretion, that the user has violated any of these Terms (especially Section 7, Usage Restrictions).

9.2. Effects of Termination

Upon termination, the user's right to use the Service will cease immediately. In case of termination due to user breach, IntelliDeep will not be obligated to refund subscription fees paid.

10. Service Availability (Implicit SLA)

10.1. Maintenance

IntelliDeep makes reasonable efforts to maintain 24/7 Service availability, but does not guarantee the absence of interruptions. The user accepts that scheduled interruptions may occur for maintenance or updates without compensation.

10.2. No Performance Warranty

IntelliDeep does not guarantee processing speed, response time, or the absence of errors in analytical information.

11. Subscription and Payment Conditions

11.1. Renewal

All subscriptions will automatically renew at the end of the billing cycle unless the user cancels their subscription before the renewal date.

11.2. Rate Modification

IntelliDeep reserves the right to modify subscription rates at any time, with at least thirty (30) days' prior notice to the user.

11.3. No Refunds

Subscription payments are non-refundable, except as expressly provided in the company's specific refund policy.

12. Quantitative Limitation of Liability

To the maximum extent permitted by law, IntelliDeep's total liability for any claim, damage, or loss arising from the use of the Service will be limited to the total amount paid by the user to IntelliDeep in the three (3) months immediately preceding the event that gave rise to the claim.
